Did you hear about a 71 year old man, who drowned in a swimming pool in a group home?  The group home is own by a 61 year old woman.  The woman was arrested on suspicion of 16 felony counts of elder abuse, not to mention an unlicensed board and care facility.

It is alleged that 22 disabled and mentally ill people lived in converted chicken coops and used buckets for toilets.  I would like to know where the families of these people are.  How can they allow these people to live this way?

Authorities are investigating.  The victim’s children are suing a woman for the death of their father.  Even though the victim suffered from dementia, alcoholism and a hip fracture, he should not have been given alcohol or left unsupervised to drown.

If you believe your loved one is the victim of elder abuse, contact a Elder Abuse attorney to investigate your allegations.

Everyone knows someone who is walking around minding their own business when all of a sudden they slip and fall.  It just happens; there is nothing in the way.  The person feels silly and makes excuses like being clumsy when he or she gets up.  They realize they are in a lot of pain.

Some people are clumsy but in most cases, there are other reasons for the fall.  These include uneven sidewalks, unexpected or awkwardly placed steps, wet floors or steps, a floor mat that is not laying completely flat, or a hole or crack in the street, just to name a few.

It does not matter how old a person is; these falls can happen to any age person; you do not have to be elderly to fall.  I always tell my clients and friends that if this happens to them, they should consult an experienced personal injury attorney immediately.

I just heard about a school bus driver, who made a U-turn in front of a pickup truck.  The bus had 21 students aboard.  Lucky for the school bus driver none of the students was hurt. The school bus driver was arrested on suspicion of misdemeanor drunk driving (blood alcohol content above the legal limit) and child endangerment.  It seems she was drinking the night before and the alcohol was still in her bloodstream.  The school district will make a decision whether to suspend or fire her.  She has been a bus driver for 16 years and has never been involved in an accident.  Several parents called to say she is a good person.

Driving under the influence of alcohol is one of the most dangerous things to do, especially when children are with you.  It does not matter if the school bus driver is a good person.  She put the lives of 21 children on the line when she took the wheel of that bus.  She is lucky that they did not get hurt or that the incident did not result in the death of any of those children.  If these children were hurt, the parents should consider consulting a personal injury attorney, one that represents victims of bus accidents.

Recently a neighbor of mine asked me to explain the dangers of asbestos exposure to her.  I told her that asbestos has been linked to Mesothelioma cancer and exposure to it is very dangerous.  Asbestos is a material used in construction.  If it is fitted tightly into a product, such as house siding or floor tiles, there are no health risks.

However, it poses health problems when fibers are present in the air that we breathe.  Exposure can affect your health if you have been exposed to it for a long time, how often, the size of the fibers, etc.  If inhaled several times, it can cause a scarring on your lungs, making it difficult to breathe.  The most dangerous risk is the chance of Mesothelioma, a rare cancer on the chest or abdominal cavity.  A smoker who has inhaled asbestos increases their risk of lung cancer.

I told my neighbor that if she or someone she knows has been exposed, she has legal rights and an experienced personal injury attorney in asbestos lawsuits can help.  Treatment for Mesothelioma is very expensive.

A famous fashion photographer from Brazil, Alberto Jose Serejo, was killed by Daniel Howell, a Joshua tree resident while he was under the influence of prescription drugs and inhalants.  The accident occurred in front of the Joshua Tree Inn.  Mr. Howell was exiting Highway 62, ran a curb and hit Mr. Serejo.  Mr. Serejo was taken to a local hospital where he died from his injuries.

Mr. Howell never stopped until about an hour later when he crashed again.  At this time, he was arrested for the accident that killed Mr. Serejo.  Mr. Howell is under arrest for DUI, hit and run driving and vehicular manslaughter.

Mr. Serejo’s family may be entitled to receive wrongful death damages from Mr. Howell since his carelessness caused Mr. Serejo’s death.  This compensation can be used for the funeral expenses and loss of companionship.  A lawsuit can never bring back a loved one but the survivors have the right to hold the negligent party accountable for his actions.  A good personal injury attorney can pursue the interests of the family members, keeping them informed all the way.

At our family Sunday dinner, my nephew was complaining about a friend of his who was stopped by a police officer for riding his bike through a stop sign without stopping first.  It is funny because in today’s newspaper, I read about something very similar.

It seems a student at Santa Ana College was riding his bike to his next class; he had earphones in both ears.  The street was clear so the student did not stop at the stop sign – just breezed right through.  Within minutes, a police officer was upon the student – sirens blaring and lights flashing.  The officer asked the student how he thought he would be able to hear cars honking at him; he advised the officer that he did hear him.  The law allows you to have one earphone in your ear, but not two.  The officer asked him, “If you were in a car, would you have stopped and he said, “Yes”.  The student thought a warning would have been fair but he was given a ticket.  The student violated two sections of the California Vehicle Code: (1) Section 22450(a) – Failure to stop at a stop sign and (2) Section 27400 – Wearing a headset or earplugs.  The amount of the ticket was $397.

I told my nephew that someone riding a bike must abide by the same rules of the road that someone driving a car does. According to the California Department of Motor Vehicles, over one hundred people are killed and hundreds of thousands of people are injured in bicycle accidents each year.  I told my nephew that even though bicyclists think they own the road, they do not.  Had the student been hit by a car at that intersection, he would have needed a very smart and experienced personal injury attorney to help him.

Statistics show that about 30 out of every 1,000 births results in a birth injury.  A child injured at birth can become a lifetime of challenges.  Unfortunately, medical errors take place everyday.

Examples include a twisted umbilical cord, fetal distress, birth trauma, or not ordering a cesarean section delivery when necessary.  If birth trauma (fetus does not receive enough oxygen) occurs during delivery, it can result in permanent brain damage, Cerebral Palsy (damage to the part of the brain that control motor skills, sensory functions and cognitive thought) or even death.  The doctor must act quickly to avoid this type of injury.  A baby can be born with shoulder dystocia.  This results from improper use of forceps.  It will give the infant limited ability to move his or her arms or hands, can cause paralysis, etc.

A birth injury can cause extensive financial burden on the family.  It could last a lifetime.  Giving birth is supposed to be a very happy time, but when medical malpractice occurs, the joy is immediately taken away.  Anyone going through this should be compensated for present and future expenses.  There is a statute of limitations to file a lawsuit.  While there is not enough money to compensate for the trauma of a child with a birth defect, an experienced San Bernardino birth injury attorney can help to provide monetary consideration for the child.

Recently, I spent the day at Big Bear Lake; the weather was beautiful and so was the lake.  However, just as I was getting ready to come back home, around 4:00 p.m., a pickup truck crashed into a motorcycle – causing a traffic delay at the height of evening traffic.  The motorcyclist sustained multiple injuries; he was taken to a local hospital; he was in a great deal of pain.

An eyewitness, who was behind the motorcycle, said it looked like the truck was making a left-hand turn – in front of the motorcycle.  The witness said she saw the two vehicles crash, sending the motorcyclist over the hood of the truck.  She thinks the truck driver hit the brakes, but not soon enough.

A helicopter paramedic was in the area and stopped to help; the Big Bear Lake and City fire departments also responded.  The Sheriff’s Department is investigating what caused the accident.  I always tell my family and friends that motorcycles are fast and drive in and out of traffic quickly; many cars and trucks do not see them.  I advise them that if they are ever involved in an accident with a motorcycle to contact a personal injury attorney who focuses on motorcycle accidents.  For information about motorcycle laws, visit www.bikerrights.com

I recently read about a county fair where a teenager was thrown from a high-speed spinning ride.  She flew into an aluminum fence.  Luckily, there was an EMT close by.  The girl, age 15, was in a lot of pain and suffered from shock.  She was hospitalized.

It seems the over-the-shoulder restraint did not work correctly.  Investigators are looking into the cause of this accident; they are also interviewing witnesses.  Initial reports state there is no evidence that a mechanical malfunction caused this.  The ride is closed for now.

It is sad when a young girl looks forward to a day at the fair and ends up injured and in pain.  The family needs to be compensated for expenses.  Anyone injured at a local amusement park or fair, should definitely consult an experienced personal injury lawyer in the San Bernardino area.

Last month was the 12th Annual West Coast Monster Truck show.  Proceeds are donated to breast cancer research.  It was a good weekend and supported an excellent cause.  Even though most had a good time, not everyone attending a monster truck show can say the same.

Not long ago a 6-year old boy was killed and a man was severely injured at a monster truck show in Tacoma, Washington.  This happened when one of the trucks, driving around in circles, had pieces of metal fly off it, over the safety barrier, and hit the young boy and man.  The metal knocked the man down and hit the boy in the head, causing him to bleed.

Both victims were taken to a local hospital where the boy died later in the night.  The organizers of the show said they follow safety guidelines and do not know how this happened.  They are investigating the accident.

How sad.  Even though most people attending monster truck rallies have a great time, sometimes tragedy strikes. If you or a loved one ever suffer from an accident like this or any type of accident for that matter that is caused by someone else’s negligence, remember that a knowledgeable San Bernardino county personal injury attorney can at least help you get compensation for expenses, injuries and damages.
