When an individual dies because of the negligence or carelessness of another person, it is a wrongful death.  Sometimes it is because of actions that were taken or actions that were not taken. 

A wrongful death is not a criminal action; it is a civil one.  It is the responsibility of a family member or representative to file a suit on behalf of the decedent.  The suit will compensate those who suffered emotionally and monetarily.  A family member can also sue for punitive damages.  Punitive damages punish the person who caused the death.  In order for a defendant to be found guilty, it must be proved that he or she is responsible for the death.

Have you heard that the California Highway Patrol has created a two-year traffic safety program to try to reduce fatal motorcycle accidents and injuries in San Bernardino, Los Angeles, Orange, and San Diego Counties?  It seems these counties have a large amount of fatal accidents each year – making them high-risk.

 

The program involves law enforcement from the air and educating the public about sharing the road with motorcyclists.  It will include two public service announcements promoting the safety of helmets and fifteen motorcycle safety presentations in each county.  In addition, it will also include a minimum of nine safety enforcement operations in high-risk areas.

 

The National Highway Traffic Safety Administration funds this program.

Several months ago, the Aquinas High School in San Bernardino got some bad news.  A former student was in a serious accident in San Francisco where he attended college.  He is in a coma.  His family is left with enormous medical bills. 

The students at Aquinas High School rallied together to help this family.  They promoted a car wash and raised $9,000.  Other donations were received and the students were able to give the family a total of $12,000 towards the medical bills.  A miracle took place and after several months, the young man has made almost a complete recovery. 

It is always nice to have a happy ending to a story that did not start well.

A very popular High School football coach and his family were the victims of a fatal accident recently.  According to California Highway Patrol, the coach’s car became wedged between two tractor-trailers and burst into flames on the southbound 15 Freeway in Ontario.  This incident caused a six-car pileup and minor injuries to others.   

An investigation into the cause of the accident is underway.

The Orange County Register recently reported that there have been 34 alleged deaths from Toyota vehicles since 2000.  According to the National Highway Traffic Safety Administration, complaints about the Toyota Prius hybrid grew by about 1,000 in a week.  Toyota has recalled 8.5 million vehicles in the United States and other countries because of gas pedal, floor mats and brake problems. 

The government is investigating these problems.  According to a Toyota spokesperson, Toyota has repaired about 500,000 of the 2.3 million vehicles recalled because of a sticky gas pedal.

According to the San Bernardino Sheriff’s Department, a woman was driving her Mercury Villager on Interstate 15 last week when it crashed into a stopped tow truck on the center divider.  Her husband and son were in the vehicle with her.

The woman died at the scene and her son died later at Loma Linda University Medical Center.  The Highway Patrol is investigating the accident.

A 20-year old man traveling through the Cajon Pass last week crashed into a disabled tractor-trailer north of Highway 138.  Paramedics found the man suffering from multiple injuries; he died at the scene.

The California Highway Patrol is investigating this accident.  The man may have been a soldier stationed at Fort Irwin.

I urge all drivers to take caution on Interstate 15 – the scene of multiple accidents in recent weeks.  Of course, you should proceed with caution on any road.

Recently the Orange County Register reported that a surgeon at Children’s Hospital operated on the wrong part of a child’s body.   It seems this is the third incident in four years.

The child was having a small fold of tissue behind the upper lip surgically loosened.  Instead of performing this procedure, the surgeon loosened tissue underneath the child’s tongue.  Luckily, the child will not experience any long-term harm.  Even though the hospital had rules in place to avoid mistakes such as this one, it happened anyway.

The hospital advised that it would work to implement process improvements and refine policies and procedures on an as needed basis.

Toyota’s problems keep going.  Now, U. S. safety regulators have opened an investigation into problems with the brakes on the 2010 Prius.  The Prius is the world’s top-selling hybrid vehicle.  The Nikkei newspaper reported that Toyota would recall about 270,000 new Prius vehicles in the United States and Japan.  However, Toyota representative Mike Michels said Toyota has no plans for suspension or a recall for the United States of Prius vehicles at this time.

The U. S. National Highway Traffic Safety Administration said they received over 100 complaints about braking problems after drivers rolled over bumps or potholes.  They advised that four motorists reported accidents because of the braking problem. 

Toyota sold approximately 140,000 Prius hybrids in the United States last year.  Toyota reported that they have reworked the software program that controls the interaction between the regenerative braking and friction braking systems.  According to Prius owners, the regenerative brakes slip on bumpy and/or icy roads causing the vehicle to lurch forward.  This happens before the traditional brakes engage. 

This is another example of when manufacturing parts fail the driver and cause personal injuries.

Recently in the news, we have learned that driver negligence is not the only reason for motor vehicle accidents.  Toyota has recalled about five million vehicles in two different announcements because of a potentially faulty gas pedal.  This has affected many various models manufactured between 2004 and 2010.

 

The first recall, Floor Mat Entrapment, regards the potential for an unsecured driver’s floor mat to interfere with the accelerator pedal, causing it to stick in the wide-open position.  The second recall, Pedal, is where the gas pedal has the potential to stick in a depressed position.  Steve Wozniak, the Apple co-founder, announced that his 2010 Toyota Prius unintentionally accelerates to almost 100mph when he uses his cruise control.  Dealers will begin receiving the new parts in the coming days.  Toyota announced that new car sales of these vehicles (about 60% of Toyota dealer’s inventory) are suspended until the problem is fixed.
