A motorcycle accident is not only devastating, but it can be brutal as well.  Every year thousands of motorcyclists die or are severely injured.  A motorcyclist can suffer a life-altering disability as a result of a crash.

Motorcyclists only have a helmet and a thin layer of clothing to stand between them and the asphalt.  They do not have the protection that a 3,000+ pound passenger car provides, such as seat belts and air bags.

A 35-year old man walking along a major road in Apple Valley just before midnight the other night was hit by a motorist and severely injured.

 

Apparently he was not only walking in the traffic lanes with his back towards the traffic, but he was dressed in dark-colored clothing, when he was hit.  He was taken by air to a local hospital.  

 

The 70-year old driver told officials that he did not see the man.  Walking at night and wearing dark clothing is a hazard and a danger to both the pedestrian and the motorist.  When walking at night it is important to be seen.  Wearing reflective clothing is a good defense against invisibility.

Even though California is known for its beautiful weather, there are still elevations, especially mountain cities that get snow and ice.

 

On a day, not too long ago, two people were killed and two critically injured when the driver, a 45-year old Sugarloaf woman, of an SUV lost control on an icy part of Highway 38 near Big Bear City.  The SUV spun around and landed on its side, slamming the roof into a tree on the shoulder of the highway.

 

There was a man riding in the front passenger seat and two passengers in the back seat. The driver and the passenger in the front died at the scene.  The two back-seat passengers were critically injured and taken to Loma Linda Medical Center for treatment.

 

The California Highway Patrol is investigating the cause of the accident.

On the morning of August 10, a 45-year old woman, lost control of her automobile as she exited Orange Show Road.  Apparently she drove through the intersection at the end of the off ramp, became airborne, flew over a wall and fell 30 feet.  She died at the scene.

 

Officials are investigating to determine why she did not stop at the intersection and why she lost control of her auto.  They are checking to see if the vehicle had a mechanical malfunction or if something was in the road that caused the accident.

 

I believe it would be in the best interests of the woman’s family to contact an experienced Personal Injury attorney to investigate this accident for them.  Perhaps the accident was a result of an auto product defect and if so, the manufacturer could be held responsible.  I extend my condolences to the family of the woman for their tragic loss.

Recently a neighbor of mine asked me to explain the dangers of asbestos exposure to her.  I told her that asbestos has been linked to Mesothelioma cancer and exposure to it is very dangerous.  Asbestos is a material used in construction.  If it is fitted tightly into a product, such as house siding or floor tiles, there are no health risks.

 

However, it poses health problems when fibers are present in the air that we breathe.  Exposure can affect your health if you have been exposed to it for a long time, how often, the size of the fibers, etc.  If inhaled several times, it can cause a scarring on your lungs, making it difficult to breathe.  The most dangerous risk is the chance of Mesothelioma, a rare cancer on the chest or abdominal cavity.  A smoker who has inhaled asbestos increases their risk of lung cancer.

At our family Sunday dinner, my nephew was complaining about a friend of his who was stopped by a police officer for riding his bike through a stop sign without stopping first.  It is funny because in today’s newspaper, I read about something very similar.

 

It seems a student at Santa Ana College was riding his bike to his next class; he had earphones in both ears.  The street was clear so the student did not stop at the stop sign – just breezed right through.  Within minutes, a police officer was upon the student – sirens blaring and lights flashing.  The officer asked the student how he thought he would be able to hear cars honking at him; he advised the officer that he did hear him.  The law allows you to have one earphone in your ear, but not two.  The officer asked him, “If you were in a car, would you have stopped and he said, “Yes”.  The student thought a warning would have been fair but he was given a ticket.  The student violated two sections of the California Vehicle Code: (1) Section 22450(a) – Failure to stop at a stop sign and (2) Section 27400 – Wearing a headset or earplugs.  The amount of the ticket was $397.

 

I told my nephew that someone riding a bike must abide by the same rules of the road that someone driving a car does. According to the California Department of Motor Vehicles, over one hundred people are killed and hundreds of thousands of people are injured in bicycle accidents each year.  I told my nephew that even though bicyclists think they own the road, they do not.  Had the student been hit by a car at that intersection, he would have needed a very smart and experienced personal injury attorney to help him.

On October 25, 2009 Robert Hamilton, 37, was killed in a car accident, according to The Press Enterprise.  Mr. Hamilton was traveling with a friend, Rick Batiste in Adelanto, when the vehicle went out of control, flipped over and landed on its roof.  The auto caught fire.  Mr. Batiste was able to be out of the vehicle but Mr. Hamilton was not, and died at the scene.  Police are investigating what made the auto go out of control and catch fire.

The California Highway Patrol reported that Adelanto is the scene of several fatalities and numerous injuries from car accidents.  In the year 2007, San Bernardino County reported 308 deaths and close to 10,000 injuries involving motor vehicle accidents.

Something caused this vehicle to flip over – perhaps it was a vehicle defect or mechanical malfunction.  Police report that Mr. Hamilton was not driving recklessly and alcohol did not play a part in the accident.  If investigators determine that the accident was because of a product defect, Chevrolet, the manufacturer of the vehicle, could be liable for the accident.  The family could check into filing a wrongful death claim for compensation to cover the funeral, lost wages and any expenses resulting.  An experienced and aggressive personal injury lawyer can advise them of their legal options.

According to the Orange County Register, five people were involved in a head-on crash on the 91 Freeway today.  Two women from San Bernardino were killed.  The accident happened early this morning, around 3:00 a.m.

A motorist was driving the wrong way in the Fast Trak Express lanes – she was heading west in the eastbound lanes.  She collided with a 2009 Chevy Silverado carrying four passengers - two young girls, ages 11 and 15 were hospitalized.  The passengers in the Chevy were not wearing their seatbelts. The 21 year old driving the Toyota Tacoma in the wrong direction was the only one wearing a seatbelt.  She was rushed to UCI Medical Center and is facing charges of driving under the influence.

As a serious injury attorney, I see clients every day with cases just like this one.  Tragedies caused by the negligence and carelessness of another human being. But it’s so sad when the injuries are multiplied because simple precautions like wearing a seat belt weren’t taken. Please don’t misunderstand.  The accident was clearly not the fault of the the family in the Chevy, but it’s my sincerest wish that they had been wearing seat belts.  Unfortunately, we will never know how much of the injuries could have been prevented had they been wearing their seatbelts.  Wearing a seatbelt increases your chances of surviving a serious crash, such as a head-on collision.

Big rigs and other large truck accidents can cause serious injuries. This is due to the truck’s sheer size and weight. Many big rigs weigh over 80,000 pounds - compared to an automobile that typically weighs 3,000 to 4,000 pounds.  This huge size difference makes it difficult for the truck driver to see every vehicle around the truck and this can be dangerous.
